Order

  1. By making an order and confirming the reservation (in the case of Credit Paying Agencies) or payment (in the case of Pre-Paying Agencies) it shall be understood that the Agency gives its consent to the offer made by TAT and the contract shall be understood as formalised.

  2. Once the Agency clicks on the “I have read and accept the general conditions. Order requiring payment” button, the order shall be binding upon the Agency. TAT shall send a confirmation of the order by e-mail to the Agency within the next twenty-four (24) hours, informing the Agency that the order is being processed and containing the details of the contract entered into.

  3. If there are any problems or questions, the Agency can contact TAT by one of the following means:

    • Telephone: +34 695525664, between 8.00 am and 6.00 pm from Monday to Friday and between 9.30 am and 1.30 pm on Saturdays and Sundays from 1st November to 31st March and between 8.00 am and 8.00 pm from Monday to Friday and between 8.00 am to 6.00 pm on Saturdays and Sundays from 1st April to 31st October, except for local bank holidays.

Payment Method

  1. For Pre-Paying Agencies, the payment method offered is via credit card.

  2. For Credit Paying Agencies, a charge shall be made to the account provided in the contract by the Agency when formalising the Services.

  3. Until the Agency pays the price of the Services in full, TAT shall retain ownership of the Services involved in the order pending payment.

Contract Execution and Duration

  1. Once the contracting process has finished and the reservation or payment has been confirmed, when the date indicated in the description of the Service arrives, the Agency may access the acquired Services on the dates included in each description.

  2. This contract shall remain in effect for as long as both parties have commitments to fulfil under said contract.

Right of withdrawal and cancellation policy

  1. Since the service pertains to a service involving leisure activities, the Agency does not have the right to cancel the contract.

  2. The price of the Services is not refundable under any circumstances, including the non-use of the Services. However, TAT provides the following cancellation policy.

Cancellation Policy

The TAT cancellation policy is subject to the following conditions:

  1. Pre-Paying Agencies:
    If the Agency has contracted an excursion, cancellation shall be allowed via the Website by accessing “My Reservations”. The applicable refund in the event of cancellation depends on each Service and therefore shall be specified in the description of each one; generally, TAT allows cancellations, refunding 100% of the price of the Service up to 48 hours before the tour's departure. However, this may vary depending on the Service and therefore we recommend that the Agency accesses the description of each of the excursions to obtain information about this right. 
    If a route has been contracted, cancellations are allowed via the Website, by accessing “My Reservations”, with a refund of 100% of the price being permitted up to 16 days before the route's departure date.If you wish to cancel the reservation less than 16 days before the route's departure date, the following sums shall be refunded:

    • 95% of the total price of the excursion if the cancellation is made between 10 and 15 days before departure.

    • 85% between 3 and 10 days.

    • 75% within 48 hours of departure.

    • No refund shall be made if clients fail to appear.

    Said refund shall be made by TAT within 48 hours of receipt of the cancellation request. Also, once the request has been made by the Website, the Agency shall be informed by e-mail via the “My Reservations” section that said cancellation is being processed.

  2. Credit Paying Agencies:
    If the Agency has contracted an excursion, cancellation shall be allowed via the Website by accessing “My Reservations”. The applicable refund charge in the event of cancellation depends on each Service and therefore shall be specified in the description of each one; generally, TAT allows cancellations, without charge up to 48 hours before the tour's departure. However, this may vary depending on the Service and therefore we recommend that the Agency accesses the description of each of the excursions to obtain information about this right.
    If a route has been contracted, cancellations are allowed via the Website, by accessing “My Reservations”, free of charge up to 16 days before the route's departure date.
    If you wish to cancel the reservation less than 16 days before the route's departure date, the following charges shall be made:

    • 5% of the total price of the excursion if the cancellation is made between 10 and 15 days before departure.

    • 15% between 3 and 10 days.

    • 25% within 48 hours of departure.

    • 100% if clients fail to appear.

Data Protection

  1. The information provided below by TAT is intended to inform you of the privacy policy that is applicable to the personal information pursuant to these General Conditions.

  2. TAT complies with all the requirements specified by the applicable law in the area of personal data protection. All of the data in our custody are processed in compliance with legal requirements and rely on both technical and organisational measures to ensure their confidentiality. Agencies also undertake to comply with all the requirements established by the legislation in force concerning the protection of personal data.

  3. You agree that all the information and data you give to TAT shall be accurate and truthful.

  4. We hereby inform you, and you (the Agency) expressly give your consent so that the data you provide us with, and any data obtained from your relationship with us, if they are considered to be personal data, can be included in a computer file(s) under the responsibility of TAT for the following purposes: for the maintenance, compliance, development, control and management of the reservation and purchase and to provide the contracted Services to its clients.

  5. Third-party data: the Agency guarantees that it has given prior notification and obtained the express consent of its clients, who are natural persons, so that their data, including specially protected data if necessary, can be passed to TAT so that they can be processed for purposes related to general administration management, maintenance, compliance, development, control and the management of the relationship that arises between the client and us, and so that it can contact the Agency if necessary in order to locate them during or after the contracted activity.

  6. Forwarding of data: 
    During the contract procedure you will be asked for your credit card information, which will be reported to the financial institution that handles the payment. This request will be made for the main purpose of validating the card, and is in keeping with the free and legitimate acceptance of the legal relationship between the Agency and TAT, the development, compliance and control of which necessarily imply verification of these data against third-party files, as required in order to comply with the specified purposes.

  7. You can exercise your rights to access, correct, delete or oppose the processing of your data by writing to TAT., located at Calle Pablo Iglesias, nº 84, CP 08908, L'Hospitalet de Llobregat (Barcelona, Spain), or by sending an e-mail to JULIÀ incoming@julia.net, attaching a copy of an official ID document and indicating on the envelope or subject line, as applicable: Contracting Conditions Data Protection.

  8. Pursuant to the foregoing, it is assumed that if you provide us with your information, you expressly authorise us to process it as described above.

Intellectual and Industrial Property Rights

  1. All intellectual and industrial property rights used or incorporated in relation to the Service are the property of or licensed to JULIÀ or the Agencies.

  2. The tickets may not be reproduced, edited or altered.

Liability Disclaimer

  1. JULIÀ disclaims all liability that may arise from the improper use by internet users of its website and the online purchasing process.

  2. It also disclaims all liability for any potential harm caused by third parties and that are not attributable to JULIÀ.

  3. JULIÀ shall not be liable for any interruptions, delays, errors or malfunctions in the services, or in general for any other inconveniences that are caused for reasons beyond the control of JULIÀ and/or that are due to the user’s malice or negligence, and/or that result from force majeure or acts of God.

  4. Any links or hyperlinks shown that are external to JULIÀ are for information purposes only and are beyond the control of JULIÀ, which shall not be liable for the information contained therein.

Contract Validity

  1. If any of the clauses in these General Conditions is deemed void or inapplicable, this shall not affect the remaining clauses, which shall remain valid.

Applicable Legislation and Jurisdiction

  1. In those cases where the law allows the parties to submit to a jurisdiction, both parties expressly renounce any other jurisdiction to which they may be entitled and agree to submit to the Courts of the city of Barcelona (Spain). If the regulation provides for selecting the applicable laws, both parties shall expressly renounce any other jurisdictions to which they may be entitled and subject themselves to Spanish law.

General Information

  1. The following will be considered “General Conditions” and will govern the online contracting procedure offered by GB Solutions t/a Tick-A-Ticket (hereinafter referred to as “TAT”).

  2. TAT inform the user, the travel agency or similar business entity (hereinafter the “User” or “Agency”) of these General Conditions, which are made known to the Agency before the start of the contracting process. The Agency, by clicking on the button “I have read and accept the General Conditions or "I have read and accept the General Conditions agrees to accept them fully and unreservedly, along with any specific condition that may apply.

  3. Through these General Conditions, the User is informed that TAT may, at any time and without prior notice, modify the contents of these General Conditions and of any specific condition that may exist.

Identification 

  1. This contract is offered by GB Solutions SL t/a Tick-A-Ticket, with tax identification number (C.I.F.) B123123123, located at Carrer de Dalt, 12  nº 5, 43382, Maspujols, Tarragona, Spain.

  2. The User is the Agency acquiring the attraction, activity, service, hotel or package (hereinafter the “Services").

  3. TAT differentiate between three types of Agencies:
    1. Pre-Payment : Agencies who under contract have agreed upon the pre-payment method, which consists of paying the sum established in each of the Services through the Website using its payment gateway (hereinafter, and for the purposes of these conditions the “Pre-Paying Agency”).
    2. Deposit Agency : Agencies that under the contract deposit an agreed working deposit with TAT that will be used against any purchases and supplemented as and when required. 
    3 Having agreed upon the credit , which consists of using the Website to make the reservation of the Service, without making any payment at the time of the reservation, with this payment being made later using the Agency's bank account number provided in the contract between the Agency and TAT. (Hereinafter and for the purposes of these Conditions, the “Credit Payment Agency”). All payments being transferred and cleared a minimum of 7 days prior to redemption date.

Preliminary information

  1. Steps to enter into the Pre-Paying Agency Contract: 
    On the Website, an Agency must select, using the search engine, the type of excursion or route that it wishes to find. Once selected, it can add its reservations and a page will open showing its basket of selected excursions and routes; to continue purchasing, it must complete the following three steps: (i) confirm the selected excursion or route, (ii) complete the data concerning the contact person from the Agency and all passengers and Agency clients that will be attending, and, if appropriate, any remarks, (iii) once the previous step is completed the Agency must read and accept the general contracting conditions and click on “I have read and accept the General Conditions. Order with payment obligation”, “confirm and pay", and then a screen will open where the Agency can enter the bank information, and once these steps have been correctly completed, the contracting process is finished. The Agency may also consult the purchased Services in the “My Reservations” section.

  2. Steps to reserve Services for Credit Payment Agencies:
    On the Website, an Agency must select, using the search engine, the type of excursion or route that it wishes to book. Once selected, it can add its reservations and a page will open showing its basket of selected excursions and routes; to complete the reservation, it must complete the following three steps: (i) confirm the selected excursion or route, (ii) complete the data concerning the contact person from the Agency and all passengers and Agency clients that will be attending, and, if appropriate, any remarks, (iii) once the previous step is completed the Agency must read and accept the general contracting conditions and click on “I have read and accept the General Conditions. Reservation with credit fee”. “Confirm”, and once the displayed steps are correctly completed the reservation process is finished and a reservation reference will be generated. Once completed, the Agency may also consult its reservations in the “My Reservations” section.

  3. File and accessibility of the electronic document: 
    We file the electronic document that formalises the contract. You may access the document, which will be sent to you if you send an e-mail to the contact address shown in the clause called: “Identification of the parties”.

  4. Identifying and correcting data entry mistakes:
    Our registration procedure lets you check and correct any mistakes before finalising your registration. Once the contracting process has been completed, you may call the TAT telephone number +34 69 55 25 664, which is staffed every day of the week except local bank holidays between 9.00 am and 9.00 pm from Monday to Friday and between 9.30 am and 1.30 pm on Saturdays, or send an e-mail to the contact e-mail address that appears in the clause called: “Identification of the parties”, to request that the relevant data be corrected.

  5. Language:
    The contract must be formalised in English or Spanish.

Purpose

  1. The purpose of the General Conditions is to determine the legal conditions applicable to the online sale process and reservation management between TAT and the Agency that allows the latter to reserve and purchase the services offered by TAT (hereinafter: “the Services”).

Characteristics of the Services

  1. In the TAT e-commerce environment, the Agency may reserve and contract various services for its final clients. A description of each service will be provided once the service is selected and clicked on.

Price and Availability

  1. The Services show the final full price thereof and detail any taxes and any other additional expenses that may be applicable.

  2. We make every effort to offer precise and complete information about the service. The TAT online store features the most up-to-date information possible about the various Services available.

  3. TAT may change the Services prices as it deems necessary. As a result, the User, when accessing websites showing the prices of the TAT Services, must make sure that these are the most recent websites and not an older version stored in the browser's cache. It is for this reason that when viewing the prices of the Services, the User agrees to click on the “Update” icon. If not, TAT shall not be liable for any discrepancies between the price shown for the Services and the latest price, the latter of which shall be applied.
